Shaun Bailey is our director and principal lawyer. Shaun brings the benefits of 25 years of specialisation as legal adviser to the Australian construction, development and engineering sectors. That experience includes a decade as a partner in a top tier Australian construction law practice.
From project inception through to delivery and final certification, Shaun has advised a diverse range of commercial sectors. His project experience includes roads, rail, bridges, waste recycling, major hospitals, pipelines, schools, social housing, tunneling, water infrastructure, retail majors, green star rated commercial office development, high density residential building work, tourism & hospitality, power generation & transmission, corrections facilities, port pavements, hydrocarbon storage, materials handling, logistics, mine development & outage work, data storage, automation technology and web-based portals.
Confidential expert determination and commercial arbitration has been a significant part of Shaun’s practice over his career, including several significant matters for the NSW Government and for government-facing private sector organisations. Frequently, Shaun has been required to manage dispute processes within the context of an ongoing commercial relationship.
Transactional assistance includes major design consultancy agreements for integrated “value capture” developments, design & construct contracts, construction management agreements, bid agreements, engineer procure & construct (EPC) contracts, engineer procure construction management (EPCM) contracts, Furniture, Fixtures, and Equipment (FF&E) contracts in tourism and hospitality, retail consumer building contracts for regulated services, back-of-house supply chain agreements and NSW government GC21 contracts. Shaun is also experienced in gaining access to airspace on projects where scaffold or the crane radius necessarily exceeds site boundaries.
Shaun’s construction-related insolvency experience includes project restructuring, project risk reviews, contract terminations, calling and defending securities, dealing with voluntary administrators and liquidators.
Recognised as a leading practitioner in the field, Shaun has also advised on statutory Security of Payment issues in all Australian states and territories.
