Acted for the building contractor in relation to multi-million dollar Supreme Court proceedings concerning refurbishment of an existing structure for development of approximately 110 strata title residential apartments. The litigation involved a coordinated response to over one thousand statutory warranty defective works claims by the owners corporation, individual owners and the Department of Fair Trading. An extensive bespoke joint inspection and structured negotiation process assisted the parties to reach a multi-party resolution of all defect issues. Commercial claims were resolved in the contractor’s favour upon a successful senior executive appraisal with the assistance of a neutral independent third party.
Greenknowe Avenue – Elizabeth Bay
Acted for the construction manager of a strata title residential development (of 31 apartments) in relation to statutory warranty defective works claims by the owners corporation and individual owners. The role included defending claims for recovery by home owners warranty insurer, (under an HIH policy). A bespoke joint inspection, testing and structured negotiation process assisted the parties to resolve all defect issues, prior to commencement of litigation and without payment under HOW policy.
Botanic Cove – Gladesville
Acted for the contractor in relation to multi-title development at Gladesville, NSW. The role included assistance in management of defect claims made by individual owners and rectification orders issued by Hunters Hill Council, upon completion of the project.

Acted for the contractor in resolving defect claims made by the strata title owners corporation and individual owners.
